Identity of the Data Controller

EFD Energy Ltd. Şti, we take the security of your personal data very seriously and respect your privacy. In this respect, we present to your information below, under which conditions all your personal data are obtained, how they are processed, our sensitivity to protect and your rights regarding this personal information, within the scope of the Personal Data Protection Law No.6698 (“Law”).

Some definitions in this clarification text are given below.

Personal Data: All kinds of information regarding an identified or identifiable natural person

Relevant Person: Real person whose personal data is processed

Law on Protection of Personal Data (“KVKK”): Personal Data Protection Law No.6698, which entered into force after being published in the Official Gazette on April 7, 2016

Data Processor: Real or legal person who processes Personal Data on behalf of the data controller based on the authority given by him.

Data Supervisor: Natural or legal person who determines the purposes and means of processing Personal Data and is responsible for the establishment and management of the data recording system.

Your personal data,

• EFD Energy Ltd. Offered by Şti; production, sales, purchasing, etc. Through the information we have requested within the framework of our activities related to the execution of services,
• Through the information you provide to our employees or suppliers verbally, in writing, electronically or through paper forms in order to obtain information about our services,
• EFD Energy Ltd. Şti, in a physical or virtual environment for purposes such as establishing a commercial relationship with, bidding / requesting, through business cards given face to face or at a distance, verbally or in writing or electronically, or information forms filled out on our website,
• Data obtained from websites, blogs, surveys, informative articles and similar websites and social media, data provided by public databases, profiles and data open to sharing on social media platforms,
• In a physical or virtual environment to apply for a job, face-to-face or distant information, verbally or in writing or electronically, or through resumes transmitted from employment sites or information forms filled out on our website.

It can be collected and processed for the following purposes.

• For the continuation of business processes in a technological sense, all employees, candidates, customers, suppliers, etc. saving and processing personal data in enterprise resource planning software,
• Obtaining the necessary records for the continuity of ongoing commercial relations with our customers, ensuring the continuity of customer relations,
• Carrying out the production, purchasing, sales and after-sales service processes of our company,
• Ensuring customer satisfaction and meeting demands,
• Ensuring the safety of our workplaces,

• Processing or storing all customer and employee data when necessary to fulfill the obligations arising from legislation,
• Evaluating and recruiting employee candidates, continuing the work processes of the employed personnel (employee, intern, apprentice, etc.) and performing employee satisfaction activities,

Your personal data obtained before 7 April 2016, which is the effective date of KVKK, in accordance with the above-explained means or other ways, are also processed in accordance with these terms and conditions and stored both in digital and physical environment.

Transfer of Personal Data

Your personal data, within the scope of the law and relevant regulations for the purposes described above, in cases where data transfer is required, limited to the reason that needs to be transferred, to service providers such as information technology, archive, printing house, card printing, distribution company, and cooperation It is transferred to other third legal persons we are in, within certain confidentiality agreement conditions.

Storage and Protection of Personal Data

Your personal data will be kept confidential in the database and systems at Smart Energy in accordance with the 12th article of KVKK; It will not be shared with third parties in any way other than legal obligations and regulations specified in this document. Our company is obliged to prevent the unlawful processing of personal data in accordance with Article 12 of the KVKK, to prevent the access of unauthorized persons to the systems and databases in which your personal data are stored, to take software measures and physical security measures such as access management. If it is learned that personal data is obtained by others illegally, the situation will be immediately reported to the Personal Data Protection Board in accordance with the legal regulation and in writing.

About your personal data under the law;

• What information we have on our side,
• Learning whether it has been processed,
• Requesting information if it has been processed;
• Learning the purpose of processing and whether it is used by us for these purposes,
• To learn the third parties to whom they are transferred at home or abroad;
• Request rectification if incomplete or incorrectly processed;
• To demand the deletion, deletion or destruction or anonymization of personal data within the framework of the conditions stipulated in Article 7 of the KVKK in case the reasons requiring processing are eliminated;
• In these cases or in case of correction, requesting that these be notified to third parties to whom data is transferred;
• If you think that a result has arisen against you by analyzing the processed data through automated systems, do not object to this situation;
• In the event that you suffer a damage due to unlawful processing, you have the right to demand that this damage be compensated.

Within the scope of the relevant law, if you submit your applications regarding your personal data through one of the following communication channels, you will be provided with a written return within 30 (thirty) days at the latest in accordance with Article 13 of the Law.

If the transaction requires cost, the tariff determined by the Personal Data Protection Board will be applied. If the request is rejected, the reason (s) for rejection will be justified in writing or electronically.
